Hire Agreement
Hours of hire
- A day is unless otherwise stated in the contract, eight consecutive hours in any working day.
- A working week is from the time started on Monday through to the finishing time on Friday.
- A week is classed as seven consecutive days.
Delivery and collection
- We will deliver the Plant and Equipment to the Site and collect it. The cost of delivery and collection will be notified to you prior to the period of hire.
- We will give you an estimated time for the arrival of the Plant and Equipment on Site. We will try best to arrive promptly, but we cannot always guarantee the arrival time.
Payment
- The Hire Charges will be agreed prior to the delivery and will be based on the length of time for which you require the Plant and Equipment.
- If it has been agreed for you to hire the plants for a longer period, you must pay the Hire Charges applicable for the whole period.
- We may ask you for a deposit payment in advance. If you give us more than 72 hours ‘notice that you wish to cancel the hire, then we will repay the whole of any such advance payment. If you give us less than 72 hours’ notice that you wish to cancel the hire, then we will repay 50% of the advance payment. We will repay the whole of the advance payment if hire of the Plant and Equipment does not proceed due to a fault of our own. The deposit will be re paid after an inspection that the plant has no damage
Loss, theft and damage
- The Customer is fully responsible for the safety of all machinery once signed for and in their possession
- If the Plant and Equipment is lost, damaged, stolen or destroyed whilst in your care or as a result of your failure to ensure that the Site is safe, you will be liable for the cost of repairing or replacing the Plant and Equipment.
- You must notify the police immediately if the Plant and Equipment, or any part of it, is stolen, or has been criminally damaged
- If any machinery and or attachments or misplaced, missing or reported stolen the higher will bear full costs of the loss of all equipment.
- Where the Plant and Equipment, or any part of it, is lost, stolen, damaged or destroyed you must notify us immediately either via phoning 07445258429
- The Hirer when hiring self-drive must take all reasonable precautions to ensure they are aware of the continuing condition of the plant and the Hirer will be totally responsible for the safe use of the plant and the reporting of, and payment for, rectification of all damage (except for fair wear and tear) to the plant whilst the plant is on site.
Repairs and Breakdowns
- In Order To provide a reliable service, all our stock are maintained and serviced on a regular basis, in the unlikely event that a machine breaks down, the loss of any attachments or shows any form of warning lights, fuel or hydraulic leaks during a hire period it is the customers responsibility to contact us immediately. DO NOT USE THE MACHINERY.
We will send a qualified Fitter directly to you at a reasonable time or arrange a speedy replacement. The hire company will not be liable for any downtime. - Any breakdown or loss of performance of the whole or any part of the plant must be notified to us immediately. Any claim for breakdown time allowance will only be considered from the time of this report
- The Hirer is responsible for all costs and losses resulting from any breakdown and / or damage arising from the misuse or misdirection of the plant or the negligence of the Hirer, their agents, servants or any other party.
- Although every possible precaution has been taken to ensure that the equipment is in good serviceable condition, no liability whatsoever can be accepted for the consequences of any failure or inaccuracies of the equipment. The Hirer is expected to satisfy themselves that the equipment is functional before attempting to use it on site
Inspections and Servicing
- The Hirer shall allow access to Arnold Excavation Hire, their agents and their insurers at all reasonable times to inspect, repair, test or adjust the plant. Such work will be carried out at times convenient to the Hirer wherever practical.
Unsuitable Ground and Operating Conditions
- The Hirer will be totally responsible for the ground condition upon which the equipment is to work and must provide excavator mats or equivalent wherever unsuitable ground conditions could threaten the security of the plant. The Hirer will be responsible for any costs of recovery of plant from unsuitable ground
Notification of Accidents
- It is the duty of the Hirer to notify us immediately by telephone (07445258429) if the plant is involved in an accident resulting in damage to property or injury to any person and confirm this in writing giving full details within 24 hours. In respect of any claim not within the liability of the Hirer, the Hirer shall make no promise or offer of payment or admission without Arnold Excavation Hires written permission.
- You must notify us immediately if there is any accident involving the Plant and Equipment which results in damage to the Plant and Equipment or to other property or injury to or the death of any person
- Whilst the equipment is in the possession of the customer during the hire period, and or any extended period resulting from early delivery or late collection, the customer accepts all risks for personal injury, public liability, personal liability and or damage to property related to the use of the hired equipment.
Re-hiring/Selling to Third Parties
- All plant, equipment or any part thereof shall not be re-hired, always sub-let or lent to any third party and the ownership shall remain with Arnold Excavation Hire.
- The Hirer must not remove plant to any other site location without prior notification to Arnold Excavation Hire.
- Under no circumstances must any machinery be removed from the delivered site without prior consent from the hire company.
Fuel
- All machinery will have a full tank of fuel upon delivery and is included within the agreed price prior delivery
- We use Commercial Fuel (Red Diesel) in our machines, any attempt to forcefully remove fuel is illegal and will be picked up on our tracking system through hours worked
General
- All operators must adhere and understand in full all manufacturer instructions and or manuals prior to the use of any machinery hired.
- It is the customer’s responsibility to ensure that they and any other person they allow to operate any hired equipment, is suitably trained and instructed to operate the equipment safely
- All our machinery is hired out in a clean and presentable manner. Although we appreciate that it is not brand new, we do expect our equipment to be treated with due care and attention and ask that it is returned to us in a similar state you received it.
